RETURN
POLICY
In return for
Way-Fil Jewelry providing you access to its inventory, you hereby
agree that all orders placed on the Way-Fil Jewelry.com web site shall
be subject to the following return policy, as modified from time to
time by Way-Fil Jewelry, unless otherwise agreed to in writing by
Way-Fil Jewelry. When you place an order from Way-Fil Jewelry, we
will ship the merchandise to you via courier on the Friday following
acceptance of your order. If the aggregate valuation of the merchandise
in the order being shipped is less than seven thousand U.S. Dollars
($7,000), Way-Fil Jewelry shall ship the merchandise for Tuesday delivery;
if the aggregate valuation of the merchandise in the order being shipped
is equal to or greater than seven thousand U.S. Dollars ($7,000),
Way-Fil Jewelry shall ship the merchandise for Monday delivery. Way-Fil
Jewelry will provide you with a refund for merchandise of the
purchase price paid by you to Way-Fil Jewelry, provided: 1) you return
the merchandise by the first Friday following your receipt of the
merchandise or, if earlier, by the first Friday following the courier's
first attempted delivery of the merchandise; 2) you ship the merchandise
being returned by registered mail or other courier providing package
tracking ability; 3) you obtain carrier insurance against the loss,
damage and theft of the merchandise, payable to Way-Fil Jewelry, for
the aggregate retail value of the merchandise being returned (as specified
by Way-Fil Jewelry when you placed the order for the merchandise);
and 4) you include with the merchandise a written explanation of the
reason for the return. Once Way-Fil Jewelry receives the merchandise
and determines that it is in the same condition in which it was sent
to you, Way-Fil Jewelry will credit your account for the refund. Should
Way-Fil Jewelry determine that the merchandise is not in the same
condition in which the merchandise was sent to you, Way-Fil Jewelry
will notify you. In the event the merchandise is lost, stolen or damaged
while being returned, you agree to promptly use your best efforts
to obtain the insurance payment on behalf of Way-Fil Jewelry and pay
any deductible required by such insurance. After Way-Fil Jewelry receives
the insurance payment, Way-Fil Jewelry shall credit your account the
refund, provided that the amount retained by Way-Fil Jewelry equals
at least the price of the merchandise. In the event Way-Fil
Jewelry determines that returned merchandise is not in the same condition
in which the merchandise was sent to you and that the carrier is not
responsible for such change in condition, Way-Fil Jewelry will not
provide a refund and, at your option, send the merchandise back to
you once you pay for shipping and handling. For example, should you
attempt to change a stone on a piece of jewelry and damage the piece,
Way-Fil Jewelry is under no obligation to provide a refund.
